1. Agreement to Terms

By accessing or using fypnow ("the Service"), operated by FYP Now LLC, a Delaware limited liability company ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

fypnow is an AI-powered analytics platform that helps creators and businesses analyze TikTok video performance, identify content patterns, track competitors, and generate data-driven content strategies. The Service includes free tools, paid subscription plans, and AI-generated insights.

3. Account Registration

  • You must provide accurate, complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to use the Service.
  • One person or entity may not maintain more than one free account.
  • You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

  • Paid plans are billed on a recurring monthly or annual basis through our payment processor.
  • Your subscription renews automatically unless you cancel before the end of the current billing period.
  • Prices may change with 30 days' notice. Existing subscriptions will honor the current price until the next renewal.
  • Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge to request a refund.
  • Usage limits (videos scraped, scripts generated, competitor analyses) reset monthly. Unused quota does not roll over.

5. Acceptable Use

You agree not to:

  • Use the Service to violate any applicable law or regulation.
  • Scrape, crawl, or otherwise extract data from the Service for competing products.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Use the Service to harass, stalk, or harm other individuals.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use AI-generated scripts or content from the Service to impersonate real individuals without their consent.
  • Resell access to the Service without our written permission.

6. TikTok Data and Third-Party Platforms

  • fypnow analyzes publicly available TikTok data. We are not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.
  • We do not guarantee the accuracy, completeness, or availability of third-party platform data.
  • TikTok may change their platform, APIs, or policies at any time, which may affect the functionality of our Service.
  • If you connect your TikTok account, you authorize us to access the data permitted by the scopes you approve. You can revoke this access at any time.

7. AI-Generated Content

  • The Service uses AI to analyze videos and generate insights, scripts, and recommendations.
  • AI-generated content is provided for informational and creative purposes only. It is not guaranteed to be accurate, complete, or suitable for any specific purpose.
  • You are solely responsible for reviewing, editing, and verifying any AI-generated content before publishing or acting on it.
  • We do not claim ownership of AI-generated content created for you. You retain rights to use it as you see fit.

8. Intellectual Property

  • The Service, including its design, code, branding, and documentation, is owned by FYP Now and protected by intellectual property laws.
  • You retain ownership of any content you upload or create using the Service.
  • By using the Service, you grant us a limited license to process your data as needed to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, fypnow and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

  • You may cancel your account at any time through the billing settings or by contacting us.
  • We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users.
  • Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
